Two Israeli soldiers charged with raping a female soldier to receive lighter sentence


Two Israel Navy soldiers who had been charged with raping a female soldier on their base will be convicted of carrying out an indecent act, as part of a plea bargain.


In the amended charge sheet, the rape charge was replaced with an indecent act, and the prosecution will demand a prison term of 8-9 months, which the soldiers have already served in military prison.


The amended indictment says that one evening at the end of March the two defendants, who served as administration soldiers, met the female soldier for the first time, while driving her and her friends in a military vehicle. During the trip the female soldier gave her telephone number to one of the defendants.


Later, toward 1 A.M., the two defendants collected the soldier from her home and drove to another part of the camp. The three sat in the car and chatted, and at a certain stage the two defendants carried out a sexual assault on the female soldier, despite her objection.


The female soldier filed a complaint against the two, First Sgt. Shai Rafailov and Sgt David Suissa, with the Military Police, which opened an investigation. The first indictment was served in April.

Lawyer Tami Olman, who represented Suissa with Shadi Sarugi, said in response: “I said from the beginning that the complaint was biased and unrealistic. Fortunately after questioning the complainant and the many contradictions in her versions – the prosecution understood that the right thing to do was to remove the rape charge and minimize the offenses as well as the punishment.”
